Service Level Agreement
Service Level Agreement:
This Web Site Availability Service Level Agreement applies to you if you have ordered ANY hosting plans ("Service") and you are in good financial standing with QWHUP.COM. Uptime Guarantee of 99% will be determined at the end of your billing term by the QWHUP.COM 's monitoring system and no other.
If you have:
- (100% - 99% uptime) -- No Refund
- (99% - 97% uptime) -- 15% Refund
- (97% - 95% uptime) -- 25% Refund
- (95% - 90% uptime) -- 50% Refund
- (89.9% and less uptime) -- 100% Refund
You will not receive a refund larger than what you have paid. A refund will not be issued on addon services, but only on the actual hosting monthly fee.
QWHUP.COM does not include the following events in the calculation of the monthly uptime, since we have no control over the events. QWHUP.COM shall not be liable or deemed to be in default for any delay or failure in performance under this Agreement or interruption of service resulting directly or indirectly from acts of God, civil or military authority, acts of public enemy, war, terrorism, riots, civil disturbances, insurrections, accidents, fire, explosions, earthquakes, floods, the elements, strikes, labor disputes, shortages of suitable parts, materials, labor or transportation, magnetic interference, interruptions of electrical power or other utility service, unavailability of any telecommunications or wireless service or connection to any telecommunications or wireless service or any cause beyond the reasonable control of QWHUP.COM.
Credits shall not be provided to you in the event that you have no Web Site Availability resulting from (i) Scheduled maintenance, (ii) Your behavior or the performance or failure of your equipment, facilities or applications, or (iii) Circumstances beyond QWHUP.COM 's reasonable control, including, without limitation, acts of any governmental body, war, insurrection, sabotage, embargo, fire, flood, strike or other labor disturbance, interruption of or delay in transportation, unavailability of interruption or delay in telecommunications or third party services (including DNS propagation), failure of third party software or hardware or inability to obtain raw materials, supplies, or power used in or equipment needed for provision of your Web Site.
On-line problems occur continuously. There might come a time when you cannot access your website or any other service. This is not necessarily due to QWHUP.COM. Perhaps your ISP is experiencing technical difficulties, or there might be a routing problem between your ISP and QWHUP.COM, making communication difficult or impossible. We cannot bear the responsibility of such problems. Our monitoring agents determine the uptime of our service, and not anyone client's experience.
